32 | Information provided by the Reporting Party indicates that a Daycare child had inappropriate interactions with another child in the home due to neglect by licensee or physical abuse.
Based on the documents and statements obtained, it was confirmed that Child #1 (C1) was instructed to inappropriately touch an older child (C2). C1 disclosed that the Licensee was present in the same room when the incident occurred but was sleeping. C1 stated that C2 instructed C1 to touch their private area. C2 confirmed that the incident occurred and that they instructed C1 to touch C2 in their private area, however, stated that the Licensee was awake in the same room. Licensee disclosed that they did not see or hear anything and they were in the same room but awake and on the couch when the incident occurred.
Therefore, based on observations and interviews which were conducted and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 Chapter 3 Article 06 Subsection 102417 (a), is being cited on the attached LIC 9099D.
