On 9/2/26 at 8:25am, Licensing Program Analysts (LPA) Jeanine Lipsey, and Licensing Program Manager (LPM) Rita Ramos conducted an Unannounced 3 year Required Annual Inspection visit. LPA/LPM met with Co Director Giessel Ayala and toured the facility. Facility is currently licensed for a capacity of 30 children. LPA observed 11 children and 3 staff present at the time of the visit.

While touring the facility, LPA and LPM observed that 2 rooms in the preschool side were not being utilized, however, the door to Room 1 was not locked, nor does it have a locking mechanism on the doorknob. LPA and LPM observed poison under the sink (picture was taken). LPM asked Co-Director to remove the poison from under the sink. While touring the outdoor area, LPA and LPM observed that there is puddled water by the trees. When inspecting the play structure, LPA and LPM observed trash, spiderwebs, and the rubber matting to have 2 and a half inch deep cracks which pose a tripping hazard (pictures were taken). While inspecting the yard, LPA and LPM inquired about two rooms located on the back part of the facility. Co-Director stated that they did not have access to open the rooms. Therefore, LPA and LPM were not able to inspect the rooms. LPA and LPM advised Co-Director that they need to have access to all rooms with the child care center.

While re-entering the facility after inspecting the outdoor yard, LPA and LPA entered through the kitchen and observed 2 poisons (Raid and Hot Shot roach and insect killers). LPA and LPM advised Co-Director that all poisons should be kept locked and storing them under the sink or on a shelf would not suffice. LPA asked the Co-Director if the facility has a concern for insects due to LPA and LPA observing 3 poisons, and Co-Director stated no. ---Page 1 of 3

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

While inventing the food storage, LPA and LPM observed that the facility stores their rice (which is the rice that they cook and serve the children at the facility) to be stored in a Laundry Detergent container that holds 33lbs (pictures were taken).

After inspecting the kitchen and the classrooms, LPA and LPM inquired about rooms and space upstairs due to facility sketches provided to the department not having them noted. Co-Director allowed LPA and LPM entry into the space upstairs and LPA and LPM observed that there are 5 rooms, a bathroom, a dining area, and a kitchenette. LPA and LPM observed that 2 rooms were not open. Per Co-Director, they do not have the keys to the 2 rooms. LPM asked Co-Director if anyone lives or resides in the rooms. Co-Director initially stated no then stated, "I don't know." LPM asked Co-Director to confirm the hours of operation and Co-Director stated that they are from 6AM to 6PM. Co-Director confirmed that they are not aware of anything that occurs after 6PM.

While requesting to review files, LPM asked Co-Director if there is a space where the LPA can type their report, Co-Director allowed LPA and LPM to use the library area. The library has 2 entry points, one door directly across from the library and one door accessible via the hallway next to Room 1. The Co-Director entered the library while on the phone and informed LPA and LPM that the Licensee, Emilia Lara, was on the phone. Licensee was adamant that LPA Lipsey conducted an annual visit "last year." LPA informed Licensee that a visit had not been conducted since 2022. Licensee informed LPA that some of the documents and forms that LPA is requesting cannot be made available since they are not at the facility. LPA informed Licensee that the files and documents should be made available to the department upon request. Per Licensee, they have not been available for 3 days. LPM asked Co-Licensee if Co-Licensee has taken the Step 2 Orientation for Record-keeping. Co-Director stated that they have not. LPM went over documents to have in order to be a Director and be responsible for the day-today operation. Co-Director asked if the Licensee is aware of the responsibility to be at the facility on a day-to-day operation. LPM informed Co-Licensee that they are because the department does not license anyone if they have not taken the orientation. LPM asked Co-Director how often is Licensee present at the facility since the Licensee is also a Co-Director and Co-Director stated that they have only been a Co-Director for a week, and Co-Director stated that Licensee is only available maybe once a week. LPM took the time to show Co-Director how to access the online orientation and discussed the importance of taking the orientation to ensure that the facility is in compliance. The Licensee called the Co-Director to speak with LPA and LPM at minimum 5 times. --P2 of 3

The Licensee called the Co-Director to speak with LPA and LPM at minimum 5 times during the visit to inform LPA and LPM, that documents and information LPA and LPM are requesting are not available. Licensee stated that the LPA incorrectly counted census the last time LPA was at the facility. LPA informed Licensee that LPA counted the census for both the preschool component and the infant component and the facility is licensed to care for up to the age of 6, however, Licensee had an 8 year old and an 11 year old present. Per Licensee, the 8 year old was in care because a parent could not find care and that the 11 year old was a 13 year old and does not count.

LPA and LPM stepped away at approximately 1:30PM and returned at 2:30PM to have lunch. While completing the review of files and documenting deficiencies observed, the Licensee asked to speak to LPA and LPM. At approximately 3:35PM Licensee informed LPA and LPM that their Director leaves at 4PM and they do not feel comfortable with LPA and LPM still being present at the facility. LPM informed Licensee that the facility operates from 6Am to 6PM and LPM and LPA can be at the facility until closing which includes, up to an hour after closing. However, LPM informed Licensee that LPA and LPM are not preventing Co-Director from leaving and are also trying to leave before closing time, however, LPM had advised Co-Director that when the facility does not have documents or information available it can delay the process. Licensee corrected LPM by stating that they have called 8 times and they will continue to call because LPM and LPA do not know how to do their jobs.

Due to time constraints, LPA and LPM will return on a later date to complete the documentation of the annual inspection. However during today's visit, 14 Type Bs are being addressed.
