During the visit, LPA conducted interviews with the licensee, S1, and two enrolled preschool-age children who were verbal. LPA also obtained a copy of the LIC 9040 Child Care Roster during the inspection.
Regarding the allegation, “Licensee allows unqualified staff to provide care and supervision to daycare children,” the Reporting Party (RP) alleged that the licensee failed to ensure qualified staff were available to provide care and supervision to daycare children. LPA interviewed the licensee, who disclosed that S1 just started working with her a week ago, but had previously worked for her approximately 20 years ago; however, the licensee did not have a personnel file for S1 available for review. LPA observed that S1's criminal record clearance was still in process at the time of the inspection. The licensee also disclosed that two additional adult roommates reside in the home and do not have criminal record clearances.
Based on LPA's observations and interviews conducted, the preponderance of evidence standard has been met. The licensee allowed S1 to provide care and supervision to daycare children while S1's criminal record clearance was still in process and did not have a personnel file available for review. Therefore, the allegation that the licensee allows unqualified staff to provide care and supervision to daycare children is substantiate. A Type A deficiency was cited for the criminal record clearance violation. A Type B deficiency was cited for staff records. Please refer to the LIC 809D for additional information regarding the cited deficiencies.
LPA Gil informed licensee Carmen Algoso that this report dated 9/3/2026 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Gil informed the licensee to provide a copy of this licensing report dated 9/3/2026 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
