Licensing Program Analyst (LPA) Jeanette Estrada and Licensing Program Manager Denise Gibbs conducted an unannounced case management visit for the purpose of following up on an unusual incident report (UIR). Licensing staff met with Director and advised her of the reason for the visit.
No school age children were in care at the beginning of the inspection. Child 1 arrived during the inspection at approximately 3:00 PM. 3 more children arrived at approximately 3:20 PM.

On 9/21/26 Licensee submitted an Unusual Incident Report (UIR) informing that half the yard was under construction. Licensing staff inspected the outdoor play area. Licensing staff observed yellow caution tape as a barrier for children. LPA informed that the yellow caution tape is not sufficient to make the area inaccessible to school age children as they can walk through to the area. In the construction area Licensing staff observed buckets of exterior paint, a pocket knife, ladders, extension cords, WD-40, pruning shears, a rake, and construction tables. Per UIR the construction will be completed by 10/3/26. Today, Director stated they need to check in with contractor to confirm completion of construction.

During inspection Licensee informed that the classroom is being remodeled. Licensing staff observed the classroom to have minimal toys and materials for children to play with. Licensing staff observed books, three board games and a large connect 4 game. Licensee was informed that she needs to provide a variety of daily activities to meet the children’s needs. Licensing staff observed exposed wires, extension cords, various paper and other material not intended for children’s use throughout the classroom. Licensee cleaned all excess material on the floor, wires and extension cords during the visit. During inspection, Licensing staff observed Staff 1 provide various activities and materials for children to use.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Licensing staff observed that the walkway to access the restrooms was unsafe. Walkway was observed to have two large piles of various items. One pile measuring approximately 4’9 inches and the second one 6’1 inch. The stacked items were observed to be unsteady and a falling hazard. Other items observed throughout the walkway were buckets of interior/exterior paint, Round-up stored next to consumable items (various syrups), tools, and a weed trimmer. These items are not only hazardous to incoming children, but they are also observed to be tripping hazards. Licensee removed hazardous items during inspection and began organizing other equipment to lower the piles and steady the objects.

Before entering the restrooms Licensing staff observed an electrical panel on the wall approximately 3ft from the ground to be easily opened. The screw intended to make it inaccessible was not utilized. Licensee closed the door and tightened to screw during inspection. This program has two restrooms. Licensing staff inspected the restroom to the left and observed the lower walls along the flooring are chipped and broken. The drywall in the corner of the restroom toward the floor is crumbling. Licensing staff observed paint chipping throughout restroom and a hole in the ceiling drywall. Licensing staff observed 'Setting Compound' under the sink that could be accessible to children, the label on the bag says “dangerous”. Licensee removed items during inspection. Second restroom was observed to be free of hazards.

In the accessible outdoor play space Licensing staff observed various plastic items not intended for play such as mushrooms growing near the tree and a small New Amsterdam liquor bottle in the woodchips also near the tree.

At approximately 3:00 PM, Child 1 arrived at the facility via a school bus. Licensing staff observed Child 1 exit the school bus. Licensing staff observed Child 1 step toward the preschool entrance of the facility as the school bus driver drove away. Child 1 was left unattended outside of the facility for approximately one minute. Licensing staff observed Staff 1 opening the door to the school age entrance allowing Child 1 to enter the facility. Licensing staff inquired with Staff 1 of the arrival procedure for Child 1 and Staff 1 stated they usually enter through the school age door. Per Staff 1, Staff 2 was at the window in the preschool room for the driver to acknowledge and Staff 2 told Child 1 to enter through the school age entrance. Per Staff 1, they were building a shelf at the time but they are usually at the door when Child 1 arrives. This is an immediate risk to the safety and personal rights of children in care.
