32 | LPA interviewed 2 current staff members as well as 1 formerly terminated staff member. None of these interviews provided evidence that staff had hit a child. Interviews with 3 children similarly did not support the allegation. Based on the collected evidence, the allegation is found to be UNSUBSTANTIATED. This means that, although the allegation may have occurred or is valid, there is not a preponderance of evidence to prove it.
(2) Licensee did not follow reporting requirements
It was alleged that the licensee did not follow reporting requirements by not informing the department of a staff member striking a child. As detailed above, the allegation that a staff member struck a child was found to be unsubstantiated. Therefore, whether the licensee failed to report the incident to licensing is similarly found to be UNSUBSTANTIATED. This means that, although the allegation may have occurred or is valid, there is not a preponderance of evidence to prove it. |
