LPA interviewed staff, children and parents. Staff stated that they observed Child 1 (C1) was left unattended in the playground. Another staff escorted the child to the director’s office. Staff stated there is a director, Lisa Fuller, who is also the licensee. However, there is no director on the premises during hours the center is in operation. Staff stated they would see the director at the end of the day and will not see the director the next few days after. Designation of Responsibility to staff was provided after the initial visit on 6/16/26.

According to Title 22 Regulations, Section 101215.1 (d) The child care center director, or the substitute director as specified in (f) below, shall be on the premises during the hours the center is in operation.

LPA interviewed children. Children stated that they are aware C1 had been left alone at the playground without a teacher present.

LPA interviewed parents. None of the parents interviewed disclosed any information that supported the allegations.

LPA reviewed a document that was provided by the facility regarding “Verbal/written warning notice & plan of action” for staff. The document stated the staff did not follow company policy and left a child outside and unattended on 4/30/26. The warning notice was followed by staff termination. The UIR indicated teacher did not perform name to face protocol during transition resulting to leaving the C1 alone and unsupervised in the playground.

During record review, 1 unqualified staff was left with children without the supervision on a qualified teacher. Staff did not have Twelve post-secondary semester or equivalent quarter units in early childhood education. The staff did not have teacher exception approved by the Department.

Based on interviews and records reviewed, the preponderance of evidence has been met, therefore the above allegation that staff did not provide adequate supervision, resulting in a child being left in the playground unsupervised is found to be SUBSTANTIATED. See LIC9099D for 1 Type A and 2 Type B violation.

LPA interviewed staff, children, and parents. None of the individuals interviewed provided enough information to support the allegation. Staff stated they maintain ratio; by having floaters readily available to cover classes or they would move children to different rooms to maintain ratio.

During record review, Name to face staff training was conducted on 5/5/26 and 6/29/26 reminding staff to maintain ratio.

Based on observation, interviews and record review, there is insufficient evidence to corroborate the allegation of Staff operated out of ratio. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the allegation did or did not occur in the day care facility, therefore the allegation is Unsubstantiated.

An exit interview was conducted, report was reviewed and discussed with Director Lisa Fuller. The Notice of Site Visit was posted during the visit. Notice of Site Visit must be posted for 30 consecutive days. The director was provided with a copy of their appeal rights (LIC 9058 03/22).
