The Reporting Party (RP) stated that Child 1 (C1) was observed with bruising on their arm and a staff yelled at C1.
As part of the investigation, LPA Lucero conducted interviews with staff members and parents.
During staff interviews, staff denied observing bruising on C1. Staff reported that C1 only attended the facility for a short period and C1 seem to enjoy being at the facility. Staff acknowledge C1 would only cry at the beginning when being dropped off, but then would stop and play, and then again when parents came for pick up. Staff explained to them it seemed that C1 was overfilled with emotion which would cause the crying. Staff further explained C1 did not exhibit any challenging behaviors which would make staff need to redirect C1. Staff denied ever observing staff handle C1 in a rough manner and also denied seeing staff yell at C1.
Staff provided photos taken of C1 that staff would take throughout the day to share with parents through daycare app the facility uses. LPA observed that C1 was smiling and engaging in the day care activities. Based on pictures, LPA did not observe any obvious bruising on C1.
LPA interviewed parents, and the parents interviewed reported no concerns regarding the day care.
LPA attempted to interview children in the same class as C1, however, the children were not qualified for interviews.
Based on the information obtained during the investigation, there is no preponderance of evidence to support the allegations (1) staff handled child in a rough manner and (2) staff yelled at child. Although the allegations may have occurred or may be valid, there is insufficient evidence to determine whether the alleged violations did or did not occur. Therefore, the allegations are determined to be Unsubstantiated. Exit interview was conducted with Director Roxanne Hernandez. The Notice of Site Visit was provided.
End of Report.
