The Reporting Party (RP) stated that Child 1 (C1) was observed with bruising under their eye and was not informed by staff of any incidents that could have caused the injury, despite staff being aware of the matter. The RP also expressed concerns regarding Child 2 (C2).
As part of the investigation, LPA Lucero conducted interviews with staff members and parents.
During staff interviews, staff denied observing a bruise on C1’s face. Staff reported that they were aware of a dry skin patch and a red mark under C1’s eye. Staff stated that C1’s parent was informed of the dry skin patch and was asked to provide additional cream. Staff further disclosed that C1’s parent later notified them that C1 had a bruise, showed the bruise to staff, and reported that C2 had caused it by hitting C1. Staff stated they were unaware of the origin of the bruise, noting that C1 did not have the bruise the previous day and they did not recall C1 being involved in any incidents.
Staff acknowledged that C2 exhibits challenging behaviors and reported that the facility is actively addressing these concerns and providing appropriate resources. Staff also shared that Child 3 (C3) frequently blames C2 for hitting C1 even when C2 is not present, or in instances where staff observed another child as the cause. Staff provided an example in which C1 tripped while playing outside, and C3 immediately blamed C2, despite C2 not being nearby at the time.
Staff provided copies of C2’s safe participation plan and behavior support plan addressing these challenging behaviors. Staff also provided copies of ouch reports for C1, C2, and C3.
LPA interviewed parents, and the parents interviewed reported no concerns regarding the day care. LPA attempted to interview the children; however, the children were not qualified for interviews.
Based on the information and documents obtained during the investigation, there is no preponderance of evidence to support the allegations (1) a child sustained several injuries due to staff neglect and (2) staff did not report injuries of daycare child. Although the allegations may have occurred or may be valid, there is insufficient evidence to determine whether the alleged violations did or did not occur. Therefore, the allegations are determined to be Unsubstantiated. Exit interview was conducted with Facility Representative Masha Farshbafmerikhi. The Notice of Site Visit was posted.
