32 | During the facility tour, the LPA observed two window air conditioning units installed and three portable standing air conditioner units, however, it is believed the units are too small and cannot keep the building at a comfortable temperature with the Summer temperatures outside. The Licensee is aware of the challenges and ongoing violation of the children’s Personal Rights but there is no plan in place to repair the building’s air conditioner at this time. The Licensee instructs staff to move the “Twos” to a classroom on the infant license and move the “Threes/Fours” into the lobby hallway until pickup. The facility has not notified the Authorized Representative(s) of the condition of the building or when children have been moved to other areas of the facility. Along with Pertinent Parties corroborating the alleged allegation of children being hot and sweaty the Department also received documentation to show the indoor classroom temperatures have exceeded the Title 22 temperature threshold of 85 degrees on several different occasions. Per the Licensee, staff are currently not allowed to use the window units while the three portable standing units are one due to the electrical breaker being tripped.
Based on all the information disclosed from Pertinent Parties, documentation received and observations, the Department has determined the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
