32 | The allegation was that a child sustained an injury due to lack of supervision.
Based on interviews and information gathered, it was determined that on the day of the incident there were two staff members assigned to the Infant classroom with a total of six infants present. Staff reported that due to staffing issues, two older infants were temporarily moved into the Infant classroom.
Staff #1 stated that at the time of the incident they were changing a soiled diaper and did not have visual supervision of the remaining children in care. Staff #2 stated they were soothing a crying infant and also did not have direct visual supervision of the rest of the children.
Staff #2 reported hearing Child #1 cry. When Staff #2 turned around, they observed Child #2 striking Child #1 on the forehead with a toy. Staff #2 immediately intervened and provided comfort to Child #1. Child #1 continued crying but did not require medical attention.
The parent of Child #1 was notified of the incident and arrived shortly thereafter to pick up the child.
Based on LPAs observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, Sub Chapter 02, Infant Care Centers, 101429 (a)(1) Responsibility for Providing Care and Supervision for Infants are being cited on the attached LIC 9099D.
