32 | It was alleged that on or about February 14, 2023, a day-care child was locked in a room for a long period of time. Allegedly, during naptime, a child was refusing to take a nap. It was reported, the child has special needs and is "unable to properly communicate their needs all the time". The subject child was throwing a tantrum and out of frustration, staff allegedly locked the child in a room by themselves, to put the other children down for a nap.
It was reported that the subject child was performing aggressive behavior, so staff put the child in an on-limit room of the facility and closed the door to protect the safety of the other children, as well as themselves. Although the door does have a lock facing the inside, LPA was unable to determine if the door was locked or unlocked during the time of the incident. Other interviews disclosed that the child first ran back to the room by themselves, and later was walked into the room and staff shut the door. Staff interviews disclosed, the door was shut with the child in the room for approximately 1 to 2 minutes. "The purpose was for them to stay in there" and "so that way they wouldn't come out". Interviews disclosed once the door was closed, staff requested the licensee watch the child via the room’s video surveillance from their phone. LPA was unable to conduct interviews with all pertinent parties during this investigation, the subject child is mostly non-verbal, but demonstrated their ability to open and unlock a door.
It was alleged that staff forced day-care child to eat. A daycare child was allegedly forced to eat their lunch and if they didn't, then food would be withheld from them when they later asked for it.
LPA observed children eating their snacks and no food was withheld from them during the time LPA was at the facility. According to interviews, if a child does not wish to eat at the time, they would have an opportunity during the next meal period or snack time. If a child asks for food in between that time, they are told to wait for the next meal or snack time. If the child is still persistent, they are given a small snack.
Based on information obtained during this investigation through interviews conducted, the review of pertinent documentation, and after receiving conflicting information, the above allegations are UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegation occurred. |
