32 | It was alleged that staff operated beyond the terms of the license by often leaving one staff in the care of more than 8 children, about 12-15 children at a time. The facility is licensed for a capacity of 14, however, according to Title 22 Regulations, “…If no assistant provider is present at a Large Family Child Care Home, then the licensee shall comply with the capacity requirements for a Small Family Child Care Home as specified in subsections (b) and (c)…”
During interviews with pertinent parties and licensees’ own admission, it was disclosed that the subject staff would leave to run errands, but only with 9 children in care at a time and “never 12-15”. This staff would need to pick up their own children and provide transportation for other day care children, so they would leave the other staff with more than 8 children in care. According to staff, this happened occasionally and not all the time. During the course of the investigation, LPA learned there was no additional assistant provider present during the times transportation was being provided, leaving only one staff with more than 8 children.
Based on interviews and licensees’ own admission, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations (Title 22, Division 12) are being cited on the attached LIC9099D.
An exit interview was conducted with the Licensee, Barbara Bubello. Appeal rights were discussed and issued, and a copy of this report was provided. A Notice of Site Visit was issued. Upon receipt of this report, the Licensee shall post the Notice of Site Visit and any licensing reports documenting a type “A” deficiency. The report and the Notice of Site Visit shall be posted for 30 consecutive days. Failure to maintain posting as required, will result in an immediate $100 civil penalty.
