32 | ***THIS IS AN AMENDED REPORT DELIVERED ON 08/06/26***
Investigative interviews confirmed that the interim director was not present at the facility during operating hours, as required by regulation. Further information gathered showed that no substitute director had been designated to act in the director’s absence. There was also no formal documentation assigning a fully qualified teacher to assume director responsibilities on an interim basis. The fully qualified staff members who informally fulfilled aspects of the director role was simultaneously responsible for a full classroom, leaving them unable to attend to the broader operational needs of the center. The absence of a present, qualified administrator during operating hours is a violation of regulatory requirements.
In addition, documentation reviewed during the investigation showed at least one confirmed instance of lack of supervision in the twos classroom where biting incidents were reported to have occurred. Investigative interviews suggested that other instances of inadequate supervision may have occurred, as evidenced by multiple unexplained or insufficiently supervised child injuries. Interviews and documentation revealed several child injuries within a short period of time. The frequency, severity, and pattern of these injuries, combined with evidence of inadequate supervision and classrooms operating over ratio, demonstrate that children were not consistently safeguarded while in care.
During the investigation, it also became apparent that two children with a documented history of injuries were separated and later placed back together inconsistent with prior safety and corrective measures. This decision was not consistent with safeguarding practices and increased the risk of further harm. Additionally, the department received evidence that children’s personal rights had been violated. Multiple investigative interviews and file reviews revealed that children had been yelled at by staff. This behavior was described as occurring on more than one occasion and appears to be an ongoing concern rather than an isolated incident.
Based on the evidence supporting lack of required administrative presence, multiple confirmed and potential supervision lapses, repeated and significant child injuries, non-adherence to safeguarding efforts, and violations of children’s personal rights, the allegations are substantiated. The allegation is valid because the preponderance of the evidence has been met, therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12, Chapter 101215.1, 101223, and 101229) the deficiency is being cited on the attached LIC 9099D. The Notice of Site Visit was provided, and LPA observed posting. Licensee is advised it must remain posted for 30 days. Exit interview conducted and report was reviewed with the licensee director, Jen Brown. A notice of site visit was given and must remain posted for 30 days.
