32 | Regarding the allegation that staff did not adequately supervise children in care, interviews conducted during the investigation corroborated that staff did not visually observe one child fall from the play structure during outdoor play and did not observe another child ingesting bubble solution from a bubble toy in the outdoor activity area.
A review of the video footage further supports the fact that the two staff members responsible for the care and supervision of the children at that time did not visually observe either incident. The video footage shows that when one child fell from the play structure, one of the two assigned staff members had just exited the outdoor activity area, leaving one staff member to supervise six children. The remaining staff member was observed with their back turned toward the play structure and did not witness the child's fall. When the first staff member returned to the outdoor area and began attending to the child who had fallen, the second staff member also directed their attention to that child. During this time, another child was observed placing a bubble toy in their mouth while both staff members had their backs turned and were not visually supervising that child or the other children in the outdoor activity area.
Additionally, interviews revealed ongoing concerns regarding frequent staff turnover and the regular use of temporary substitute staff at the facility. Multiple staff members reported that substitute staff are often unfamiliar with the classrooms, the children, and established routines, which they stated negatively impacts the quality and consistency of supervision provided.
Therefore, based on LPA Gerth's observations, confidential interviews conducted, video review, and documentation obtained during the investigation, the preponderance of evidence standard has been met. Therefore, the allegation that staff did not adequately supervise children in care is SUBSTANTIATED.
