On September 15, 2022, at 11:15 AM, Licensing Program Analyst (LPA), Diana Sanchez made an unannounced complaint inspection to deliver findings for the above allegations. LPA met with provider Elsa Beileson and made her aware of the reason for today’s inspection. Current census is 2.

This agency has investigated the above listed allegations. During the course of the investigation, facility staff, daycare children, daycare parents, and neighbors were interviewed. Chula Vista Police Department (CVPD) call log was reviewed.

It was alleged that an excluded individual has been frequently present at the facility. Provider and staff denied the allegation, stating that excluded individual, Adolfo Tapia Vivanco, was last at the facility in September 2021. The exclusion order was issued October 28, 2021. During children interviews, they did not disclose seeing other persons being in the home, aside from the caretakers. Parents interviewed denied ever observing Adolfo in the home. There were no other witnesses to corroborate the allegations.

It was alleged incidents have occurred at the facility where emergency services responded and were not reported. Provider denied the allegation, stating that all emergency calls made from the facility have been reported to the San Diego Child Care Regional Office. Parents interviewed did not disclose any concerns or issues with the facility or staff. Neighbors interviewed reported observing frequent police activity at the facility, but could not provide specific dates or details. Although CVPD call logs were reviewed, LPA was unable to determine whether or not, undocumented emergency service incidents occurred at the facility which would warrant an unusual incident report.

Based on the evidence gathered, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview conducted and report was reviewed with Provider Elsa Beileson. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
