13 | On 11/07/2023 at 2:45 PM LPA, Dana Stevens, conducted an unannounced complaint visit regarding the above allegation. LPA met with Licensee, Natalia Aja Meza. There were 6 children present at the time of the inspection. During the investigation LPA conducted interviews with Licensee, assistant, daycare children, daycare parents, inspected and photographed children's play area, and reviewed facility records.
LPA observed a large palm tree in the common area where children play however a 4-foot wire fence surrounds the tree preventing the children from standing directly under the tree where palm fronds may fall. Information obtained in interviews with staff, children and daycare parents revealed that occasionally fallen palm fronds have been observed in the common area, however there was no evidence or statements obtained that palm fronds have fallen while children were present. Additionally, there was no evidence obtained of any children being injured while playing in the common area. Based on a lack of preponderance of evidence, the allegation Children play in a common area that is dangerous to children (possible falling palm fronds), is found to be Unsubstantiated. A finding that the complaint is Unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.
No deficiencies cited. Exit interview conducted and copy of report and appeal rights provided to licensee, Natalia Aja Meza. Notice of Site Visit must be posted for 30 days. |
