32 | It was determined that on 06/25/2026, the licensees did not properly supervise daycare children, resulting in minor Child #2 (C2) engaging in inappropriate sexual contact with daycare Child #1 (C1). Based on interviews with both the licensees and C2, inconsistencies in their statements were noted. Furthermore, C1’s statements have remained consistent across multiple interviews, including forensic interview.
Based on the IB investigation, interviews conducted and records reviewed, and in collaboration with outside agencies, the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. Per California Code of Regulations, (Title 22, division 12 & Chapter 3), one (1) Type A deficiency is being cited on the attached LIC 9099-D.
The Department has concluded its investigation and has determined that a civil penalty is warranted for the physical abuse of a child in care. Health and Safety Code section 1596.99 states that “physical abuse” includes physical injury inflicted upon a child by another person by other than accidental means, sexual abuse as defined in Section 11165.1 of the Penal Code, or unlawful corporal punishment or injury as defined in section 11165.4 of the Penal Code when the person responsible for the child’s welfare is a licensee administrator or employee of any facility licensed to care for children, or an administrator or employee of a public or private school or other institution or agency.
Today 10/02/2026, the Department will be issuing a civil penalty pursuant to Health and Safety Code §1597.58 for a violation that the Department has determined constitutes physical abuse in the amount of $2000.
