13 | On 9/6/2023, at 9:20 am, a complaint investigation visit was made to the facility by Licensing Program Analyst (LPA) Cunningham. It has been alleged there was a lack of supervision resulting in a child wandering away from the facility; specifically, (Child 1, approximately 2 years old) was found on the side of O’Conner Avenue (approximately 50-60 yards from the facility) by a stranger that was driving by (Witness 1). The licensee self-reported the incident within 24 hours as required. The licensee admitted that Child 1 exited the facility through the front door without her knowledge resulting in absence of supervision at approximately 9:00am on 8/31/23. The licensee stated she was supervising a group of six children in the living room and her assistant was supervising a group of five children in the daycare room. The licensee stated she walked away from the group to move laundry into the dryer, heard the doorbell ring and found Witness 1 and Witness 2 at the door with Child 1. The licensee estimates the child was unsupervised for approximately 5-6 minutes. Child 1 was returned to the licensee’s home by Witness 1 and Witness 2. Based on the licensee’s statement, the preponderance of evidence standard has been met; therefore, the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D. An immediate $500 Civil Penalty for Absence of Supervision was accessed. |
