An unannounced follow-up complaint investigation visit was conducted by Licensing Program Analyst (LPA) Yang to deliver the findings of the complaint investigation. The allegations stated that staff did not provide adequate care and supervision to infants in care; staff left an infant unattended; the facility was not maintained free of pests; staff yelled at daycare children; staff failed to meet daycare children's toileting needs; and staff engaged in inappropriate interactions with daycare children.

Specifically, it was alleged that infants were allowed to cry excessively for extended periods and that an unnamed infant was moved from one crib to another and left unattended while crying. It was further alleged that cockroaches had been observed in the kitchen, classrooms, and infant cribs; staff yelled at children due to impatience; children were not provided assistance with toileting needs; infants were not changed in a timely manner; and three- and four-year-old children were not permitted to use the restroom, resulting in children soiling themselves. Additionally, it was alleged that staff wrote children's names on a board and identified them as being "bad," causing children to become upset and cry. (Continued on LIC9099-C)

During the initial complaint investigation on May 20, 2026, LPA Yang interviewed Center Director/Licensee Martha Barron Botello (Staff S1) regarding the allegations. The Licensee denied all allegations and provided additional information regarding the concerns. This facility is a single license, combination center with an infant and preschool age component.

The Licensee stated that staff are required to provide appropriate supervision and care to children in accordance with their individual needs. The Licensee denied that infants were left unattended, allowed to cry excessively for extended periods, or moved between cribs without appropriate supervision. The Licensee stated that each infant is assigned an individual crib and that cribs are not shared between infants. The Licensee further stated that staff do not move infants from one assigned crib to another and denied that any infant had been moved to a different crib and left unattended while crying. The Licensee explained that staff routinely monitor infants through direct visual supervision and respond promptly to their needs, and provide care, including feeding, diapering, comforting, and other age-appropriate assistance.

The Licensee stated that infants' diapers are checked and changed every two hours or sooner if needed. The Licensee further stated that if staff observe an infant requiring a diaper change outside of the scheduled timeframe, the infant is changed immediately. The Licensee stated that staff are expected to respond promptly to infants' needs and ensure that appropriate care is provided at all times.

The Licensee denied that cockroaches were present inside the facility, including the kitchen, classrooms, or infant cribs. The Licensee stated that the facility maintains established cleaning and sanitation procedures to ensure the environment remains clean, safe, and sanitary for children in care. The Licensee further explained that the facility contracts with a professional pest control company to provide monthly pest control services as a preventative measure and to address any pest-related concerns that may arise.

During the investigation, the Licensee provided the LPA with documentation of recent pest control services, including invoices reflecting services completed in May 2026. The Licensee stated that the facility follows the recommendations provided by the pest control company and takes appropriate measures to address any potential pest activity. The Licensee denied observing cockroaches inside the classrooms or kitchen and stated that no cockroaches had been observed in areas where children are cared for, including infant cribs. However, the Licensee acknowledged that cockroaches had been observed near the exterior building doors. The Licensee explained that these observations were limited to areas outside the classrooms and stated that the facility takes steps to prevent pests from entering the building. The Licensee further stated that the facility is a "shoes off" facility and that staff members and children remove their outdoor shoes before entering the classrooms. According to the Licensee, this practice is implemented to help maintain classroom cleanliness and reduce the introduction of dirt, debris, and potential contaminants into areas where children are cared for.

The Licensee denied that staff yell at children or engage in inappropriate interactions with children in care. The Licensee stated that staff are expected to use appropriate communication, redirection, and positive guidance strategies when interacting with children. The Licensee explained that, due to the arrangement and layout of the classrooms within the facility, sound can carry throughout the building. The Licensee stated that some teachers become enthusiastic while teaching and may speak loudly when engaging with children during classroom activities. The Licensee clarified that she has not observed any staff member yelling at or speaking to a child in an inappropriate manner.

However, the Licensee acknowledged that teachers may occasionally raise their voices when interacting with children, primarily to gain their attention in response to the noise level within the classrooms. The Licensee stated that raising one's voice to address the group or redirect children's attention is different from yelling at a child and emphasized that staff are expected to maintain appropriate interactions with children at all times.

The Licensee denied that children were prevented from using the restroom or that children's toileting needs were not addressed. The Licensee stated that staff provide assistance with toileting and diapering as needed and monitor each child's individual needs. The Licensee stated that children are permitted to use the restroom whenever necessary and are never denied access. The Licensee explained that, due to the location of the restrooms within the facility, children are escorted by a staff member when using the restroom. The Licensee further stated that one staff member may escort multiple children to the restroom at the same time while continuing to provide supervision and assistance as needed.

The Licensee denied that staff wrote children's names on a board to identify them as being "bad" or to single them out for ridicule. However, the Licensee acknowledged that staff may write a child's name on the classroom whiteboard, one letter at a time, in response to inappropriate behavior. The Licensee stated that children whose full names remain on the board at the end of the day do not receive a gold star sticker. The Licensee explained that children have the opportunity to have their names removed from the board if their behavior improves throughout the day. The Licensee stated that the practice is intended to serve as a behavioral reminder and encourage children to make positive choices, not to shame or humiliate them. (Continued on LIC9099-C)

The Licensee further stated that children enjoy receiving gold star stickers and may become upset if they do not receive one at the end of the day. The Licensee stated that neither she nor any staff member has called a child "bad" or used other negative terminology when speaking with children. The Licensee further stated that staff do not use methods intended to shame, embarrass, or negatively label children.

As part of the investigation, the LPA conducted additional interviews and observations to investigate the allegations and assess the facility's compliance with licensing regulations. Follow-up visits were conducted at the facility on May 28, June 2, June 10, and July 07, 2026, to complete observations and interview staff members and children. During the investigation, the LPA interviewed staff members S2 through S11 regarding the allegations. Staff members S2 through S11 denied observing infants left unattended, infants being allowed to cry for extended periods without staff response, or infants being moved between cribs and left unattended. Staff also denied observing cockroaches in the classrooms, kitchen, or infant sleeping areas, and stated that children were routinely escorted to the restroom, diapered as needed, and supervised throughout the day. Staff further denied yelling at children, referring to children as "bad," or using discipline intended to shame or humiliate children. Overall, the staff interviews were consistent with and corroborated the information provided by the Licensee. Additionally, children and childcare clients interviewed during the investigation also did not provide any information to corroborate the allegations.

During each follow-up investigation visit, the LPA conducted a tour of the facility to assess conditions related to the allegations. During the follow-up visits, the LPA did not observe any conditions or practices that corroborated the allegations. The facility’s kitchen, food preparation areas, and storage areas appeared to be maintained in a clean and sanitary condition and were free of litter, rubbish, and other visible signs of vermin during the inspection visits. The LPA observed that all children present were provided with care and supervision, and no children were observed to be left unattended. During the visits, The LPA observed staff changing infants’ diapers and observed preschool-aged children being escorted by staff to the children’s restroom. The LPA observed infants being monitored by staff throughout the visits. Although some infants cried intermittently, staff responded to their needs in a timely manner, and no infant was observed crying for an extended period without staff intervention. The LPA did not observe or hear any staff members yelling at children or engaging in inappropriate verbal interactions with children.

Based on available information and interviews conducted, although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. Therefore, the allegations are determined to be unsubstantiated at this time. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the Center Director/Licensee, Martha Barron Botello. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
