A follow-up complaint investigation was conducted today by Licensing Program Analyst (LPA) Yang to deliver the findings of the investigation. The complaint alleged that facility staff yelled at children. Specifically, it was alleged that Staff S2 frequently yelled at daycare children and threatened them with isolation or other forms of punishment that were not consistent with positive discipline practices or respectful communication. It was further alleged that Staff S2 spoke to children in a manner intended to create fear in order to obtain compliance.

During the initial complaint investigation conducted on May 27, 2026, the LPA interviewed the facility’s Center Director, Nicole Del Calvo (Staff S1), regarding the allegation. During the interview, the Director acknowledged that some of the reported incidents had occurred. The Director stated that she had heard Staff S2 elevate her voice when addressing children but had not personally heard S2 yell at a child. The Director stated that, after receiving corroborating reports from other staff members regarding Staff S2’s conduct, S2 was issued written disciplinary action and provided coaching for violating company policy and Title 22 regulations pertaining to children’s personal rights. The Director stated that she takes these concerns seriously and recognized the importance of ensuring that staff understand and follow facility policies and applicable Title 22 requirements regarding appropriate interactions with children. The Director stated that on May 22, 2026, Staff S2 was issued a written warning based on reports that S2 had withheld food from children as a form of discipline, threatened children with consequences if they did not behave, and discarded a child’s food after the child did not comply with S2’s directions. The Director stated that she worked directly with Staff S2 to provide additional training and coaching regarding appropriate methods of interacting with children, communicating with children, and managing challenging behaviors. The Director stated that the training was intended to assist S2 in understanding the importance of using appropriate, non-punitive methods to redirect children and obtain compliance.

The Director stated that Staff S2 was given an opportunity to learn from the incident and was provided guidance regarding appropriate methods of addressing children’s behavior. The Director further stated that she would continue to monitor S2’s performance and provide additional direction and training as needed to ensure that staff interactions remain consistent with facility policy and children’s personal rights.

As part of the investigation, LPA interviewed Staff S2 through S5 on May 27, 2026, and July 22, 2026 regarding the allegation. During her interview, Staff S2 denied yelling at children but acknowledged that she has raised her voice when addressing children, particularly when attempting to obtain their attention. S2 also acknowledged threatening children with punishment if they did not behave. S2 attributed her actions to a lack of training and experience working with preschool-aged children. S2 stated that she did not have any ill intent and did not intend to violate the personal rights of any child. S2 stated that, following the incident, she was provided additional training and guidance by the Center Director regarding appropriate interactions with children, behavior management, and mealtime practices. S2 stated that she learned from the incident and understood that her actions were inappropriate.

The information obtained during Interviews with Staff S3 through S5 corroborated portions of the statements provided by the Center Director regarding Staff S2’s conduct. The information obtained was consistent with concerns regarding S2’s interactions with children, including the use of elevated tones, threats of punishment, and inappropriate methods of obtaining compliance.

Based on the Center Director's admission, corroborating staff interviews, and documentation reviewed during the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is substantiated. A violation of the California Code of Regulations, Title 22, is being cited on the LIC 9099-D under the report for complaint control number 01-CC-20260522111313 dated August 14, 2026. An exit interview was conducted and this report was reviewed and discussed with Center Director Nicole Del Calvo. Appeal rights were provided. The Notice of Site Visit shall be posted for 30 consecutive days.
