A follow-up complaint investigation was conducted today by Licensing Program Analyst (LPA) Yang to deliver the findings of the investigation. The complaint alleged that facility staff did not allow preschool-aged children adequate time to consume their meals. Specifically, it was alleged that Staff S2 allotted preschool-aged children approximately five minutes to eat their meals, rushed the children while they were eating, and threatened to discard food that the children had not finished consuming.

During the initial complaint investigation conducted on May 27, 2026, the LPA interviewed the facility’s Center Director, Nicole Del Calvo (Staff S1), regarding the allegation. During the interview, the Director acknowledged that the reported incidents had occurred. The Director stated that, after receiving corroborating reports from other staff members regarding Staff S2’s conduct, S2 was issued a written disciplinary action and provided coaching for violating company policy and Title 22 regulations pertaining to children’s personal rights. The Director stated that on May 22, 2026, Staff S2 was issued a written warning based on reports that S2 had withheld food from children as a form of discipline, threatened children with consequences if they did not behave, and discarded a child’s food after the child did not comply with S2’s directions. The Director stated that she takes these violations seriously and recognized the importance of ensuring that staff understand and follow the facility’s policies and applicable Title 22 requirements regarding children’s personal rights. The Director stated that she worked directly with Staff S2 to provide additional training and coaching regarding appropriate methods of interacting with children and managing behavior. The Director stated that the training was intended to help S2 understand that food and mealtimes should not be used as a form of discipline or as a consequence for a child’s behavior.

The Director stated that Staff S2 was given an opportunity to learn from the incident and was provided guidance regarding appropriate, non-punitive methods of addressing children’s behavior. The Director further stated that she will continue to monitor S2’s performance and provide additional direction as needed to ensure that staff practices remain consistent with facility policy and children’s personal rights.

As part of the investigation, LPA interviewed Staff S2 through S5 regarding the allegation. During her interview, Staff S2 acknowledged that the allegation was true and stated that she rushed children during their meal time and threatened to discard their food if not consumed quickly enough. S2 attributed her actions to a lack of training and experience working with preschool-aged children having only worked in a preschool setting for approximately one month. S2 stated that she did not have any ill intent and did not intend to violate the personal rights of any child. S2 stated that, following the incident, she was provided additional training and guidance by the Center Director regarding appropriate mealtime practices and interactions with children. S2 stated that she learned from the incident and understood that her actions were inappropriate.

Interviews with Staff S3 through S5 were conducted on May 27, 2026, and July 22, 2026. The information obtained during these interviews corroborated the statements provided by the Center Director regarding Staff S2’s conduct. The information obtained from the interviews was consistent with the allegation that S2 had engaged in inappropriate mealtime practices, including using food or mealtime as a form of discipline.

Based on the Center Director's admission, corroborating staff interviews, and documentation reviewed during the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is substantiated. A violation of the California Code of Regulations, Title 22, is being cited on the attached LIC 9099-D. An exit interview was conducted and this report was reviewed and discussed with Center Director Nicole Del Calvo. Appeal rights were provided. The Notice of Site Visit shall be posted for 30 consecutive days.
