Licensing Program Analyst (LPA), Amy Strother made a subsequent complaint investigation inspection, for the purpose of delivering complaint findings, and met with the Licensee, Emilio Perez (L1). It has been alleged that there is a lack of supervision, specifically that children are frequently in the homes backyard crying, screaming and yelling for several minutes at a time and on one occasion a child was observed standing in front of the home without a caregiver.

During the initial investigation visit on 07/02/26, LPA toured the home inside and outside, made observations, requested and received a current roster of children in care, and conducted interviews with the Licensee, assistant (S1) and 2 children (C1-C2).

Licensee denied the allegation stating that there has never been a time that there has been a child outside alone. The Licensee stated that he and his assistant take the diaper garbage out to a garbage can on the front porch, to the right, twice a day to keep the odor out of the house.

(LPA confirmed through observation that there is a garbage can located on the front porch.) The Licensee shared that while the diaper garbage is being taken out, sometime a child will come outside with them and stand at the door or on the front steps.

The Licensee agreed that they have had children outside who cry a lot or some children that would be considered to have “special needs” make a lot of loud sounds repeatedly as a means of expressing themselves. The Licensee stated that he is aware that his neighbors aren’t happy about the noise, but that the children are being supervised. The licensee gave an example of where he stands in the back yard so that he can see the whole yard.

S1 denied the allegations stating that they always supervise the children, and children are never left alone. S1 stated that no children have ever been out in front of the house alone and they no longer play outside at the neighboring park, only in the back yard. S1 stated that the children are noisy when they are outside, and when they cry she tries to comfort them or when they fight with another child she has them separate, sometimes sending them inside with the Licensee.

During LPA’s visit on 07/02/26 there were 5 children present. Two of the five children agreed to be interviewed, C1 & C2. C1 was talkative and shared with LPA the things they like to do, like play with Monster trucks. C1 stated that Emilio and S1 take care of them and that S1 is always outside with them. C1 stated that they only play in the back yard, not the front yard and that they feel happy when they are there. C2 was not willing to speak when asked a question, instead used their finger to point at things. LPA asked C2 if they were ready to go back outside and they shook their head side to side. LPA ended the interview due to C2 not wanting to use words to communicate.

LPA made observations during the 07/02/26 visit. LPA observed assistant S1 outside in the backyard with 5 children. LPA noted that S1 was positioned in a way that they were able to see the whole yard and supervise all 5 children at one time. The Licensee joined S1 and the five children outside. LPA observed the Licensee engaging the older children in playing with a ball, kicking or throwing it back and forth. LPA observed S1 encouraging the two younger children to go up the stairs and down the ladder of the small plastic play equipment.

LPA observed a younger child (C4) heading toward the group of older children playing ball, S1 was observed trying to redirect the younger child away from the game of ball. The child protested by sounding a loud shrieking sound. The child was observed to repeatedly use loud sounds to communicate.

LPA observed a child (C5) trying to remove their sweatshirt. When C5 struggled to remove the sweatshirt, they responded with loud sounds. LPA observed S1 come over to C5 to aid them in removing their sweatshirt. LPA observed children to be under the supervision of either the Licensee or S1 at all times during the visit.

During the investigation LPA Strother attempted to interview A1 on 06/30/26. On 07/02/26, LPA attempted to conduct interviews with residents of four different homes neighboring the Licensee’s home and interviewed three adults (A1 – A3).

A1 stated that they are concerned with how loud the children are at the day care, calling it “Wild America”, with children “screaming constantly”. A1 stated that they are concerned that the children’s needs are not being met. A1 stated that a child was crying for 5-6 minutes outside in the backyard and no one was consoling them. LPA asked A1 if they were able to see into the backyard to know if there was an adult near the crying child. A1 stated that there is a car port like structure, covering the view of the back yard, so they were not able to see if there was adult outside or not.

A1 stated that they observed a child standing near the open front screen door of the day care, stating that they could not see inside the home to know if an adult was standing near the door, and the child never left the front porch.

A2 and A3 both stated that the children at the day care are loud. A2 and A3 then stated that they have haven’t lived near the day care for the past three years, and have only returned to be near the day care for the last month. A2 and A3 stated in the one month that they have been living near the day care again they have not witnessed anything concerning going on, just the noise of the children playing and screaming loudly.
