On 07/02/26, Licensing Program Analyst (LPAs) Veronica Martinez and Nicole Ketterer conducted an unannounced complaint inspection regarding the above allegations. LPA met with Licensee Judith Fairall and explained the purpose of the visit. A tour of the Family Child Care Home (FCCH), including both the indoor and outdoor areas accessible to children in care, was conducted. At the time of the inspection, there were 9 children present along with the licensee's assistant.

The Department received a complaint alleging that the licensee did not ensure the daycare home was kept clean, did not keep the daycare free of pests, and that the daycare was malodorous. The investigation included an unannounced inspection, observations of the areas accessible to children, and an interview with the licensee.During the inspection, LPAs observed a strong foul odor throughout the home and outdoor play area. The presence of the insects appeared to be associated with accumulated trash and the animals housed in cages located in the yard. Inside the home LPAs observed a strong odor consistent with animal feces along with accumulated laundry and toys scattered throughout the living room area that was accessible to children. The areas accessible to children were not maintained in a clean and sanitary condition. LPAs also observed that the children's restroom was dirty had a strong unpleasant odor and was not maintained in a clean and sanitary condition. The bathroom sink used by the children was clogged and filled with standing water making it unsanitary for children's use.

Based on observations made during the inspection and the interview conducted with the licensee, the investigation determined that the allegations did occur. Therefore, the allegations that the licensee did not ensure the day-care home was kept clean, did not keep the day-care free of pests, and that the day-care was malodorous are substantiated. The preponderance of evidence standard has been met; therefore, the allegations are SUBSTANTIATED. Violations of California Code of Regulations, Title 22, Division 12, and/or the Health and Safety Code are being cited on the attached LIC 9099D. These violations pose a potential risk to the health, safety, and personal rights of children in care.

A Notice of Site Visit was issued and must remain posted for 30 days. Appeal rights were provided and discussed. Failure to comply with posting requirements may result in an immediate civil penalty of $100.

An exit interview was conducted, and the report was reviewed with the licensee Judith Fairall.
