How to read violations

Nearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.

5180:2-12-19 — Supervision

“During the inspection, it was determined that children were not being properly supervised. The following was observed: Situational awareness was not maintained by a staff member more than once. While reviewing the classroom video of several back-to-back incidents involving a child biting multiple children, the staff person working alone was observed with their back turned to six children while conversing with another staff member in the adjoining classroom. During this time, a child was able to bite another child, and the staff person did not become aware of the incident until the injured child began crying. In each instance where a child was bitten, the staff person was either engaged with another staff member or had their back turned to the known biter. There did not appear to be any structured activities occurring at the time of the incidents. A review of incident reports for the classroom indicates that 11 biting incidents occurred between 10-1-26 and 10-7-26. The incidents did not result in any of the children needing professional medical attention. Provide staff training. Submit the program’s corrective action plan, which includes a statement that training was provided, to the Department to verify compliance with the requirements of this rule.”
