Violations
Text reproduced verbatim · Texas Health and Human Services Commission, Child Care RegulationNearly every licensed provider accumulates some. A missing signature and an unlocked medicine cabinet are both “violations”, and they are not the same thing. Look at the class, the pattern over time and how quickly it was corrected — not the count alone.
Class is our grouping of the state’s own weights, reviewed per state. The agency’s own label is always shown beside it.
“One caregiver was unsure of the children's ages in her group when asked or where to locate the information for their ages. This was corrected when I reviewed the children's binder and ages with the caregiver to locate their ages.”
“The operation was not following conditions as agreed upon on a waiver/variance.”
“One director did not have a timesheet reflecting time spent at the operation, and a second director did not have accurate timesheets reflecting actual time spent at the operation.”
“The operation did not have documentation to show that either one of the two directors were present at the operation a minimum of 75% of the program?s operating hours each week or a minimum of 30 hours per week.”
“The operation has a caregiver who is under 18, and not enrolled in a childcare career program who is taking on caregiver tasks and is present where children are during the operating hours when children are in care.”
“A caregiver who was present with the children during inspection not have an eligible background check. The caregiver left during inspection.”
“The operation did not have the letter or form from the most recent Licensing inspection or investigation posted.”
“The operation did not have an inspection report for the electronic carbon monoxide detection system connected to an alarm/smoke detection system.”
“A director was not listed as a controlling person for the operation.”
“The operation did not have documentation of the electronic smoke alarm system inspection completed annually.”
“Per the DFPS investigation, it was determined that the caregiver was not adequately supervising the children on the playground when a child inappropriately touched another child in care.”
“Based on the DFPS investigation, it was found that caregivers were using their cell phones while providing care to children.”
“The operation did not report the incident involving a child who was placed at risk. The site director was alerted reagarding the incident Jan 28th via email.”
“Director changes were not reported to Licensing.”
“The two caregivers present did not know how many children they were responsible for. This was corrected when the attendance sheet was completed during dinner.”
“One caregiver was supervising 44 students in the cafeteria while the other teacher took a group of children to the restroom.”
“Observed 64 students in the cafeteria with two caregivers. The children were running around the cafeteria, opening the door for visitors, throwing food and chocolate milk cartons at each other, screaming/yelling and tusseling with each other, and jumping off the stage.”
“A staff member supervising a group of children has a pending background check on file.”
